Much of the data used can be found in the 21 series manuals and appendices. I neither support or defend the standards in use by the VA but can suggest that you search out and study the methods and references that were used in developing the CFR 38 requirements. However, as I think you have determined, the rating assigned were correct for the hearing data provided given the current rating schedule. I understand your concern to be with the standards and methods the VA uses in testing and rating hearing loss. I have read your postings and have also done some delving into the VA's methods of rating these conditions as well as looking into other aspects on hearing loss. I was not a radio operator but do have a service connected disability for hearing loss and tinnitus (100%/10%). Once again I'm asking all Radioman who suffered acoustical trauma resulting in a service connected disability for help. Now, with hearing aids (that are not allowed in testing), the amplified ambient sounds make understanding human conversation extremely difficult and frustrating. The criterion for establishing a PTA is focused only on the lower half of the human hearing range and particularly that incorporating the range of the human voice whereas the bulk of my disability resides just above the PTA testing threshold. Once again I was tested at 90DB which is more than twice the volume found in a normal conversation level making this portion of the test nonobjective, unfair, biased, and only serves to set up this claim to fail.Ģ. (But not beyond the subject’s tolerance level). The standard procedure for “Obtaining a Modified Performance-Intensity Function” lacks the tested results above the 2000 Hertz, and is performed in an artificial soundproof environment using whatever increased DB levels necessary to acquire a maximum recognition performance score. I just object to their testing for the following reasons:ġ.

Then using their scale, the combination of PTA and SR = 0 Part two’s criteria comes from CFR 4.85, Evaluation of Hearing Impairment, which defines the procedure to determine the level of hearing disability based on the findings from two tests, the Puretone and Speech Recognition Test.Įstablishing the Puretone Threshold average.īased on this formula, my PTA = 41.3 (left ear) and PTA = 37.5 (right ear). This then leaves the next question, “at what level of disability is my bilateral hearing loss”? Since Tinnitus is difficult to diagnose, I was awarded the maximum 10% disability. In a VA letter dated February 4, 2011, it was determined that I met the criteria and was granted a service connection disability that included Tinnitus and Bilateral hearing loss. On Decema hearing test by QTC confirmed that I met two of three of these conditions Or when SR, speech recognition scores using the Maryland CNC test are less than 94%.” Or when the auditory thresholds for at least three of the frequencies 500,1000,2000, 3000, or 4000 Hertz or 26 decibels or greater ģ. The auditory threshold in any of the frequencies 500, 1000, 2000, 3000, or 4000 Hertz is 40 decibels or greater Ģ. “For the purposes of applying the laws administered by VA, impaired hearing will be considered to be a disability when ġ. This section establishes the language necessary at identifying particular criteria to qualify a claim and has two parts Puretone Test and Speech Recognition Test Part one is CFR 38 3.385 – Disability due to impaired hearing and CFR 38 4.85 Evaluation of hearing impairment. The VA has a policy to address hearing loss. Glad you responded Here is my condition, rated service connected 10% tinnitus, I would like to know your word and tone scores were? Together we can use each other to build our case, as one, or as a unit suffering from tinnitus and service connected hearing loss. I would like to build a thread here with all of those shipmates that suffer hearing loss, its effects, and any positive outcomes dealing with the VA on a claim. Navy and the effects from the communication equipment, mainly the teletypes. It was suggested that I start a new blog about being a radioman in the U.S. Thanks in advance, Jim Wood rm3 USS Kilauea Ae26 and USS Sacramento AOE1.

Please reply soon as my 1 year appeal approaches. I was wondering if anyone has been able to receive more than 0% and what you did to receive financial compensation. This seems like par for the course from all the conversations I have read here. I then filled and received 10% tinnitus and a service connected hearing disability but at ZERO percent. I had a VA hearing test and was fitted for hearing aids the same day. Went in with great hearing, left with minor hearing loss that over the years has manifested itself exceeding 65% impairment at 2000hz plus. I was radio teletype operator "Yankee Station" for 3 tours.
